If you reside in the United States and you were sent notice that your Private Information was impacted in the SouthState Bank, N.A. Data Incident that occurred on or around February 7, 2024, then you may be a member of the Class and eligible for benefits. The Class specifically excludes: (a) all person who are directors, officers, and agents of Defendant; (b) governmental entities; (c) the Judge assigned to the Action, that Judge's immediate family, and Court staff; and (d) any Settlement Class Member who timely opts-out of the Settlement.
If you are a Class Member and wish to receive Settlement Benefits then you must submit a claim form by June 15, 2026.
This Settlement provides eligible Class Members with: (1) up to $3,500.00 in reimbursement for Out-of-Pocket Losses consisting of documented losses as a result of fraud and/or identity theft more likely than not caused by the Data Incident, and (2) a pro rata (proportional) cash payment; and (3) one (1) year of credit monitoring protection. Payments to Class Members are subject to a pro rata increase or decrease based on the money remaining in the Settlement Fund at the time of payment.
Identity Theft and Credit Monitoring Protection: All Settlement Class Members who do not opt out will automatically receive one year of Credit Monitoring with one credit bureau which will also include $1,000,000.00 of identity theft insurance. Once the Settlement receives Final Approval, you will be able to activate the service using the Credit Monitoring code emailed or mailed to you in a postcard, using the instructions here. Class Members do not have to file a claim to receive this benefit.
Out-of-Pocket Losses: Settlement Class Members who incurred unreimbursed documented out-of-pocket losses relating to fraud or identity theft when (i) the loss is an actual documented, and unreimbursed monetary loss, (ii) the loss was more likely than not caused by the Data Incident; and (iii) the loss was incurred after February 7, 2024, may be eligible to receive reimbursement of up to a total of $3,500.00 per Class Member. Losses include:
Bank fees, overdraft charges, late fees, or declined payment fees resulting from fraud;
Charges for credit monitoring or identity theft protection purchased in response to the data breach;
Costs incurred to place or remove a credit freeze;
Professional fees paid to address identity fraud (e.g., accountants, attorneys, fraud specialists);
Replacement costs for government-issued identification or documents;
Long-distance phone charges, postage, notary, or similar incidental costs; and
Fraudulent, unreimbursed charges or financial loss directly traceable to misuse of personal information obtained in the Data Incident.
Settlement Class Members who elect to submit a claim for reimbursement of out-of-pocket Losses and expenses must provide documentation reasonably supporting their claim. Documentation generated by a thirdparty supporting your claim can include credit card statements, bank statements, invoices, telephone records and receipts. “Self-prepared” documents such as personal certifications. declarations, or affidavits are, by themselves, insufficient to receive reimbursement, but can be considered to clarify or support other submitted documentation.
Pro Rata Cash Payment: All Settlement Class Members may make a claim to receive a pro rata (proportional) cash payment.

The deadline to submit a Claim Form online or by email is June 15, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than June 15, 2026.
